Licensing Enforcement In The Global Market Place

With the current signatories to the Bern convention at 167 (see here) the developed and developing world is seeing continual growth in the global intellectual property market.

Music licensing has been vulnerable to piracy for many years before the age of digital downloads and will continue to be a part of the maket for use of music in the consumer and business market for the foreseeable future since whilst there is a will, there will always be a way.

Yet music offers much more value than being compared in cost to a stack of copied CDs purchased from a questionable back street trader. Music curated and organised into playlists designed for your specific business needs provides a more compelling proposition than simply looking at the potential cost benefits of a complete packaged in-store music solution.  So what holds back developing countries from kick starting their intellectual property economy?

Some have deeply rooted institutions and cultures based on thinking intellectual property is free to use. Added to this any lack of interest and potential corruption within enforcement agencies to act on building an intellectual property economy means that the economy as a whole suffers.

Music businesses, record labels in particular struggle to make a profitable business because a large proportion of their potential market is literally being stollen from them.  Likewise the opportunity for international businesses to enter such markets is challenging and in some cases lacks a compelling business benefit.

Using Background Music In Your Business: A free Infographic

If your country has signed the World Intellectual Property Organization Copyright Treaty which provides protection for the rental and distribution of copyright for musicians and composers then your options will be clear. Signatory countries agree to implement the treaty within their own law.

Playing music in a business, either in a private environment, or an environment that is more public both require your business to pay for at least one type of license for playing that music under these terms.

Additionally it does not matter if the audience for the music playing is exclusively employees or a mix of employees and customers, or just customers. Playing music from the radio, from CDs from an mp3 player or music downloaded or streamed from the Internet all are covered within this copyright treaty.

But who has the right to collect the royalties for your use of the artists’ music you are playing?

How sure can you be that any of the performing and composition royalty agencies in your country actually directly or indirectly represent the artists you are playing?

The answer to that is unclear and therefore many businesses choose to simply ‘pay to play’ although doing so is costly, especially if you have a number of societies to pay.

When Is A Song Public Domain?

what is public domain music?With the announcement by a filmaker that he aims to go to court to claim that the song “Happy Birthday To You” is actually public domain I thought it would be worth just clarifying a little about public domain compositions but very briefly.

Public domain music describes compositions that are available and free for anyone to use. However, the recording, or the performance of a freely available composition will be owned by the maker of the recording or performance, or whoever the title of the copyright is transferred to.

So what compositions are public domain? Well even though there seems to be some sort of constructed confusion around the validity of the song Happy Birthday To You, it is normally very simple to define in the USA. Other countries differ slightly but in general follow the US’s ruling that any composition created before 1922 is now public domain. A useful set of questions and answers are located here.

This ruling means that providing classical music from the great composers of a few hundred years ago is easy enough if you can record them yourself. Of course not many people can record full orchestral or complex piano pieces so we still generally have to rely on the skills of musicians to make these creations available to us royalty free.

Pandora Buy Out Of Costly Performing Royalties

Pandora have purchased a terrestrial radio station to enable it to change its exclusive online streaming status with the US performing rights societies.

This means, like it’s main competitors, it is now regarded as a business with terrestrial radio interests and thus qualifies for a cheaper performing rights license.

I wonder why it took them so long to decide to do this. As terrestrial radio continues to decline due to the falling radio advertising spend I would have thought many opportunities would have been available to purchase a radio station earlier.

Buyer Refunds for Apps

In this article the BBC reports on the UK governments interest in increasing the powers of consumers to gain refunds for digital media, which includes smartphone apps, purchased and downloaded from the Internet.

I think this is good news for consumers who run the risk of being burnt by purchasing apps that turn out to be not fit for purpose. I regularly see complaints from users for apps even on the very controlled Apple App Store and it seems to me the process of gettingbone’s money back for poor products is not clear or even non existent.

So not only is is good news for consumers but also good news for developers of quality apps since the market will increase in confidence about the risk of purchasing new apps as consumers will feel kor in power to get their money back if the app doesn’t work as they expected.
